The writ petition earlier appeared on 11.11.2024 M/L. No.229 Rakib and 04.12.2024 when accommodation was sought for on behalf of the learned advocate appearing for the petitioner. Today when the writ petition has been called none represent the petitioner.

State has submitted a report which contended that the genesis of the dispute is a matrimonial feud or interference with the parents of the wife of the present petitioner. Report reflects that proceedings under Section 163 of the BNSS and under Section 126 of the BNSS have been instituted being M. Case no. 304/2024 and M. Case No. 305/2024 respectively. Enquiry reports in respect of the proceedings before the Executive Magistrate were submitted by the police authorities. According to the report the situation was normal and peaceful. Be that as it may, in view of the agony expressed by the petitioner police authorities only interfere if there is any violation of law and order. Further pendency of the writ petition is unwarranted.

With the aforesaid observations WPA 26359 of 2024 is disposed of.

Report so submitted by the State be kept with the record.
