The petitioner contends that although all the works as per the work order dated January 25, 2012, had been executed, the petitioner has not been paid the bills. This Court does not find any reason to pass the orders as prayed for in the writ petition, in view of the fact that the claim of the petitioner is time barred. In this case, 50% of the bills claimed have been paid to the petitioner. Whether the petitioner is entitled to further amounts, is a matter to be decided by the authority on the basis of records.
Under such circumstances, the writ petition is disposed of with a direction upon the Block Development Officer, English Bazar, Malda to treat the writ petition as
the representation of the petitioner and dispose of the same in accordance with law. If the records are available and it appears that the petitioner had completed the work and there were admissible dues payable, in that event such admissible amount shall be paid in accordance with law. In case no records are available and there are disputes with regard to the bills or the claims are not found to be legitimate and payable, such reasons shall be intimated to the petitioner. A reasoned order shall be passed and communicated to the petitioner within a period of three months from the date of communication of this order. This Court has not gone into the merits of the claim of the petitioner.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
