Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent authorities for disbursement of interest on delayed payment of arrear pension amount from the date of entitlement till the date of actual payment @ 18% per annum. 3.

The petitioner contends that her father late Bholanath Barman retired as a Head Teacher of Dheubhanga Primary School under Moyna Circle, District Purba Medinipur on 30th April, 1991 and expired on 8th September, 2002. The mother of the petitioner expired on 3rd January, 2010.

The petitioner is the unmarried daughter of the deceased employee. The pension payment order was issued in favour of the petitioner on 9th April, 2025. The arrear family pension was disbursed in favour of the petitioner on 26th April, 2025. However, no interest on

the aforesaid amount has been paid in favour of the petitioner. Hence this writ petition.

Mr. Sourav Mitra, learned Advocate for the petitioner submits that petitioner has already received the arrear family pension. However, no interest has been paid on the aforesaid amount. The petitioner is entitled to interest from the date of G.O. No.96-SE i.e. 13th April, 2010.

Mr. Siddhartha Ghosh, learned Advocate for the State submits that pursuant to the order passed in the writ petition being WPA 9139 of 2024, the Pension Payment Order has been issued and arrear of family pension has already been disbursed to the petitioner. There is no such delay and as such the petitioner is not entitled to any interest. He files written instruction furnished by District Inspector of Schools dated 3rd December, 2025 which is taken on record. 6.

There cannot be any dispute that the unmarried daughter of deceased employee is entitled to family pension as Government Order dated 13th April, 2010. The arrear of family pension has been received by the petitioner on 26th April, 2025 which ought to have been granted to her forthwith. The delay in disbursement of the arrear family pension entitles the petitioner to interest on the said amount.

In view of the contention raised before this Court the respondent No.2, Director of Pension Provident Fund

and Group Insurance and respondent No.3, Treasury Officer, Tamluk, Purba Medinipur are directed to disburse interest on the arrear family pension @ 8% per annum in favour of the petitioner from 13th April, 2010, till the actual payment of the arrear amount. Such payment shall be made within a period of 8 weeks from date of communication of the order. 8.

Learned Advocate for the petitioner is directed to communicate this order to respondent No.2, Director of Pension Provident Fund and Group Insurance and respondent No.3, Treasury Officer, Tamluk, Purba Medinipur, for necessary compliance.

With the above direction, the writ petition, WPA 25821 of 2025 stands disposed of.

10. Interim order, if any, stands vacated.

11. All connected applications, if any, stand disposed of.

12. There shall be no order as to costs.

13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
