The petitioners did some work for the respondent nos.2, that is, Hooghly River Bridge Commissioner (HRBC) but did not receive payment for the same. Although the respondent no.2 is admitting the claim of the petitioners, the amount due could not be disbursed to the petitioners since the requisite funds are not being released by the respondent no.1, that is, the State of West Bengal through its Chief Secretary.

Upon hearing learned counsel for the parties, it transpires that since the dues are admitted, no question of appreciating evidence on facts is necessary.

In view of the above observations, WPA 25128 of 2023 is disposed of by directing the respondent no.1State to release to the HRBC the funds for payment of the admitted dues of the petitioners within eight weeks from date positively.

Immediately upon such payment being made to the respondent no.2, the latter shall disburse the amount to the petitioners in full and final settlement of the claims of the petitioners.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
