The petitioners also filed representation on the self-same date praying for consideration of the application for mutation. The said representation has not yet been considered.
Learned advocate for the Municipality does not have any instruction as to why the application for mutation has been kept pending for such a long period of time.
In view of the above, the instant writ petition is disposed of by directing the Nabadwip Municipality to take steps for consideration of the application for mutation filed by the petitioner strictly in accordance with law after giving an opportunity of hearing to all the
necessary parties positively within a period of three months from the date of communication of a copy of this order. The Municipality shall pass a reasoned order and communicate the same to the parties immediately thereafter.
The Chairman of the said Municipality shall inform the petitioners about the formalities that are required to be completed for mutating their names in the official records of the Municipality.
The writ petition stands disposed of.
Vakalatnama filed by the learned advocate on behalf of the Nabadwip Municipality is retained with the records.
Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
