Suman Sengupta, learned counsel for State are present.

2. With the consent, the matter is finally heard. During course of hearing, learned counsel for the parties reached to a consensus. It is agreed that the present intra-court appeal may be disposed of by reserving liberty to the original petitioner to resubmit his representation before the police authorities seeking protection and in that event, police authorities may be directed to consider and decide representation in accordance with law.

Rest of the findings given by learned Single Judge may be set aside.

3. In view of the consensus arrived, impugned order of the learned Single Judge is set aside. If petitioner prefers a representation seeking protection, police authorities shall consider and decide it in accordance with law.

4. With the aforesaid and without expressing any opinion on merits, MAT is disposed of. With disposal of the appeal, the interim application is also disposed of.
