Affidavit-of-service is taken on record. Despite service, none appears on behalf of the respondents. The petitioner alleges that pursuant to a work order issued on August 22, 2008 by the Executive Officer, Manikchak Panchayat Samiti, District-Malda, all the works had been completed and duly executed by the petitioner. It is alleged that although a sum of Rs.1,91,538/- had been certified to be paid, there are still outstanding dues. The petitioner submits that the final bill which had been raised was not paid by the authority.

The writ petition lacks material particulars. No such final bill has been annexed. The prayer in the writ petition also does not support the contentions of the petitioner. Under such circumstances, no order can be passed in the writ petition due to inadequate pleadings and erroneous factual statements.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
