Petitioner was earlier granted bail by an order dated 05.02.2021 in CRM 8362 of 2019.
The petitioner was taken into custody on 12.09.2025 on the issue that an application was taken out by the Investigating Officer of the case that the present petitioner last appeared before the Investigating Officer on 25.10.2021. It has been submitted by the learned advocate appearing for the State on instructions that 6 witnesses out of 22 witnesses have been examined by the prosecution. There was an earlier direction to meet with the Investigating Officer once in a fortnight which according to the learned Trial Court has been violated and as such the earlier order was cancelled.
Consequently, the present petitioner was taken into custody. The order reflects that on 12.09.2025 the present petitioner was appearing physically before the Court and from there he has been taken into custody.
Having considered that the only subject matter of consideration by the Court was for not meeting with the Investigating Officer and on an assessment of the materials available, I do not find that the present petitioner has been creating any impediment to the progress of the trial. I am of the view that the petitioner should be released on bail.
Petitioner, namely Sk. Sharukh @ Sk. Sarukh, shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of the learned Judicial Magistrate, 2nd Court, Contai, Purba Medinipur. Learned Judicial Magistrate, 2nd Court, Contai, Purba Medinipur is directed to impose conditions which would subjectively satisfy the said Court.
Accordingly, CRM (R) 143 of 2025 is allowed.
