Affidavit of service filed in Court is taken on record. Report filed by the State is also taken on record. Learned counsel appearing for the petitioner submits as follows. The petitioner is the owner of the land in question and he is possessing the same. The private respondents are rank outsiders, who have been disturbing the petitioner and trying to grab the property. A complaint was made to the police in this regard, but was not acted upon. This prompted the petitioner to file an application under Section 156(3) of the Code. Bishnupur PS Case No.823/23 dated 07.10.2023 was consequently registered against the alleged land mafia only after an order was passed in this regard. However, no investigation is being done.
Learned counsel appearing for the private respondents denies the allegations and submits that they are actually in possession of the property.
Learned counsel appearing for the State relies on the report and submits that a specific case had been registered on the complaint of the petitioner. After completion of investigation, the same has ended in charge-sheet. A proceeding has also been initiated under Section 107 of the Code.
It appears that the police have taken steps by registering an FIR and then filing a charge-sheet. They have initiated a proceeding under Section 107 of the Code.
Therefore, no further order need be passed in this regard.
The police shall keep a sharp vigil at the locale, ensure that no harm ensues to any of the parties and see to it that no order of a civil court is violated. Surveillance shall include frequent visits by police patrol. With these observations, the writ petition is disposed of.
