Learned advocate appearing on behalf of the petitioner submits that petitioner is similarly placed as other accused persons who have been granted bail.

Petitioner is in custody since 29.11.2023, i.e. for 2 years. The prosecution intends to examine 138 witnesses, out of which 8 witnesses have been examined. Petitioner prays for bail on any stringent conditions.

Learned DSGI has submitted a report. Let the same be kept with the record.

Report reflects regarding the complicity of the present petitioner in the alleged offence.

I find from the records of the case that there are accusations against the present petitioner. However, similarly placed accused persons have been granted bail pursuant to directions passed by the Hon'ble Supreme Court as well as this Hon'ble Court.

Having considered that for more than 3 years the petitioner is in custody and substantial time would be consumed in exhausting the examination of all the witnesses, at this stage, I believe further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner shall furnish bond subject to the satisfaction of the learned Special Court in seisin of RC 03 of 2022 on such terms and conditions as the learned Special Court deems fit and proper for ensuring the appearance of the present petitioner in course of the trial.

Accordingly, CRM (M) 2345 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
