Learned counsel appearing for the petitioner places an order of the Division Bench dated 18th January, 2023 by which the Division Bench was of the view that the rejection of the petitioner's bid was in consonance with Clause 9.3 of the PCP 2020 and did not support from any mala fide. The order passed on the judgment of this court dated 27th September, 2022 and was hence set aside and the writ petition was accordingly dismissed. Since the Division Bench was pleased to dismiss the writ petition, nothing further remains in the present dispute.
The contention of learned counsel appearing for the petitioner that the petitioner is contemplating in approaching the Supreme Court against the order of the
Division Bench cannot be a ground for the writ petition to survive.
W.P.A.25912 of 2022 is accordingly dismissed without any order as to costs.
