Learned senior advocate appearing for the petitioner submits that, the petitioner was not involved in the incident. Learned advocate appearing for the State draws the attention of the Court to the statements of the eye witnesses recorded under Section 161 of the Code of Criminal Procedure (Cr..C.).

Two eye witnesses, who recorded their 161 Cr.P.C. statements implicates the petitioner in the murder of the victim by sharp cutting weapon.

The petitioner is one of the persons assaulting the victim. In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 5472 of 2022 is dismissed.
