Mr. Ekramul Bari Mr. Gazi Faruque Hossain Mr. Alauddin Ahamed Ms. Varsha Roy ...for the Petitioner Mr. Manoj Kumar Mondal ...for the State Matter relates to eligibility of one Abdul Latif Halder being respondent no.9 herein to function as President of Chaltaberia High School, District: South 24 Parganas since said respondent no.9 is working as a Primary Teacher in another school. It is contended on behalf of the petitioner who is one of the guardians of the aforesaid school that an in-service person has no right to be nominated as person interested in education or as President in the Managing Committee of a Government sponsored school.
However, today a report has been furnished on behalf of the District Inspector of School (S.E.), South 24 Parganas dated 20th November, 2024 stating that said respondent no.9 has resigned from the post of President of the Managing Committee of the aforesaid school on 8th November, 2024 and Sub Inspector of Schools, Joynagar East Circle being a Drawing & Disbursing Officer of the aforesaid school was appointed as President of the Managing Committee of the said school. It is also stated
therein that by memo dated 14th November, 2024 proposal was sent to the Joint Secretary, School Education Department for appointment of new President on the Managing Committee of the aforesaid school. Report dated 20th November, 2024 of the District Inspector of Schools (S.E.), South 24 Parganas is taken on record.
In view of the developments which have been indicated in the aforesaid report dated 20th November, 2024, it appears that grievance of the petitioner stands redressed. Therefore no further order need be passed in this writ petition.
Hence, writ petition stands disposed of.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
