Rahaman ....for the petitioner Mr. Vivekananda Bose Ms. Subhra Nag ....for the State Mr. Sanjay Saha ....for the respondent No.3 The primary grievance of the petitioner is that the Additional District Magistrate & District Land and Land Reforms Officer, Paschim Medinipur conducted a hearing on December 5, 2023 on the prayer of the petitioner for extension of the mining lease period of the concerned sand block, but no decision has been communicated to the petitioner till date.
The learned advocate appearing for the State seeks time to take instructions in this matter.
It appears from the materials on record that pursuant to the prayer made by the petitioner for extension of the mining lease period for the sand block in question a hearing was fixed on December 5, 2023. The petitioner claims to have participated in the said hearing. More than 1 year 11 months have expired since the date of
hearing and the decision appears to have not been communicated to the petitioner till date.
In view thereof, the Additional District Magistrate & District Land and Land Reforms Officer, Paschim Medinipur being the respondent No.5 is directed to communicate the reasoned order to the petitioner, if any, already passed in the meantime on or before November 26, 2025. In the event reasoned order has not been passed in the meantime, the said respondent shall fix a date of hearing as it appears from the materials on record that a long time has elapsed from the last date of hearing and the respondent No.5 shall pass a reasoned order after giving a fresh opportunity of hearing and communicate the reasoned order to the petitioner immediately thereafter but positively on or before December 17, 2025.
With the above observations WPA 25807 of 2025 stands disposed of.
There will be no order as to costs.
