Mr. Shiba Prasad Mukherjee Mr. Aniruddha Ganguly ...For the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the Title Suit No. 1113 of 2022 presently pending before the learned Civil Judge (Senior Division, 1st Court at Barasat.

It is submitted that the matter is pending since long before the Court below and as such a direction may be passed for expeditious disposal of the said suit. Since the prayer made on behalf of the petitioner is innocuous and if any order is passed in terms of the said prayer, neither party will have any cause to prejudice, service of notice and copy of the application upon the opposite party is dispensed with.

Having considered the facts and circumstances of the case and also considering the submissions made on behalf of the petitioner I find that the prayer made by the petitioner is justified.

In such view of the matter C.O. 3774 of 2024 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the above mentioned Title Suit No. 1113 of 2022 pending before the

learned Civil Judge (Senior Division), 1st Court at Barasat and to make his best effort to conclude the entire proceeding of the Title Suit preferably within a period of six months from the date of communication of this order. Urgent photostat certified copy of this order, if applied for, be supplied to the petitioner, on priority basis on compliance of all requisite formalities.
