Heard learned counsels for the parties.

The petitioner is unhappy with the process of investigation initiated at his behest pursuant to murder of his father. It appears from the case diary that the investigation involves several issues which need to be dealt with by a specialized agency. Though the police has been continuing with investigation, it shall be more effective to transfer the same to a specialized agency in order to unearth the truth and nab the offenders.

In view of the above, this Court directs that the investigation be transferred to the Criminal Investigation Department (in short, "CID") who shall hold a fair, unbiased and impartial investigation and take the same to its logical conclusion, in accordance with law.

DIG, CID is directed to nominate a competent superior officer to continue with the investigation and shall monitor the same himself.

The police authority is directed to make over case diary along with all relevant material to the officer of CID nominated for investigation at the earliest.

With the above direction and observation the writ petition is disposed of.

Case Diary be returned.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
