AD-12 Ct No.09 24.08.2023 TN WPA No. 25922 of 2022 Calcutta Motor Dealers' Association and another Vs.

Union of India and others Mr. Anubhav Sinha, Mr. Subhasis Dey, Mr. Victor Mukherjee .... for the petitioners Mr. Asok Bhowmik .... for the respondent nos.1, 2 & 3 Affidavit-in-opposition filed today be kept on record.

The writ petition itself, as rightly contended by learned counsel for the parties, has spent its force in view of the Registrar Of Companies, in the meantime, having considered the matter and marked defective the E form MGT-14 filed vide SRN-T99254823 and E form GNL-1 filed vide SRN F01722982 having been marked as NTBR (Not to be taken on record). Hence, the effect is that the original Articles of Association of the petitioner no.1-company remains. With such observations, nothing remains to be adjudicated further in the present writ petition.

Accordingly, WPA No. 25922 of 2022 is disposed of, in the light of the above observations.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
