Rakib (Rejected) CRM (M) 2347 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Station Case No. 258 of 2014 dated 08.04.2024 under Sections 395/397/412 of the Indian Penal Code, 1860.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for a considerable period of time and in spite of the period of detention of the present petitioner there has been no progress in the trial of the case, as such on any stringent conditions petitioner may be released on bail.

Learned advocate appearing for the State on the other hand submits that out of 24 witnesses proposed to be examined 20 witnesses have already been examined by the prosecution and the earlier observations of this Hon'ble Court reflects that petitioner was identified in the T.I. Parade. Having regard to the stage of the case that 20 witnesses have already been examined and only 4 witness are left to be examined, I direct the learned trial Court to conclude the

examination of the 4 witnesses proposed to be cited preferably by 31st of March, 2026.

Petitioner would renew his prayer for bail in case the directions given above is not complied with.

However, at this stage the prayer for bail being CRM (M) 2347 of 2025 is rejected.

No unnecessary adjournment be granted to any of the parties and the trial of the case would proceed in spite of the resolution of the local bar.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
