Liberty is granted to the petitioner to amend the cause title.
Petitioner is aged about 76 years and is the uncle-in-law of the deceased.
Petitioner is in custody for 356 days, investigation has been concluded, charge sheet has been submitted and the prosecution intends to rely upon 14 witnesses in order to prove its case and majority of the accused persons have been arrested. Case has already been committed to the Court of Sessions but charge is yet to be framed.
Learned advocate for the State opposes the prayer for bail and submits that there are clinching evidence so far as the
present petitioner is concerned and as such at this stage the prayer for bail of the petitioner should be rejected. I have considered the case diary including the dying declaration as well as the statements recorded of other witnesses whom the prosecution has relied upon in order to prove its case.
Having considered the complicity of the present petitioner, I am of the opinion further detention of the petitioner is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed.
Petitioner, namely, Ranjan Pal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Barrackpore. If on bail the petitioner shall not leave the jurisdiction of the ACJM, Barrackpore and shall physically appear before the Court on the date so fixed.
Accordingly, CRM (M) 2348 of 2025 is allowed. Pursuant to the directions, the Officer-in-Charge of Naihati Police Station is present along with the original case diary. His further appearance before this Court is dispensed with.
Case diary be returned to the learned advocate appearing for the State.
Show-cause report submitted be kept with the record and accepted.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
