Petitioner has approached this Court being M/L. No.228 Rakib aggrieved that in spite of informing the police authorities no steps were taken by Ekbalpur Police Station. Learned advocate for the State submits a report which deals with the fact that there were allegations of illegal construction. Consequently, police authorities had sent information to the Executive Engineer (Building), Borough-IX, Kolkata Municipal Corporation. However, relating to the illegal construction the police authorities were not informed, as such the police authorities were unable to take any steps for violation of the alleged illegal construction contended by the petitioner.

In view of the steps taken by the police authorities, I am of the opinion that the same is inconsonance with the provisions of law. Police authorities if they receive any report from the Executive Engineer, KMC, they would take steps in accordance with law.

With the aforesaid observations WPA 26351 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
