01.12.2025 IN THE HIGH COURT AT CALCUTTA (SL-130) Moumita CRIMINAL MISCELLANEOUS JURISDICTION Court No.28 CRM (A) 3855 of 2025 In Re:-An application for apprehension of arrest in connection with Margram Police Station case No. 183 of 2025 dated 08.07.2025 under Sections 108/ 3(5) of the Bharatiya Nyaya Sanhita, 2023 filed on 11.11.2025.

And In the matter of : Golam Rasul alias Golam Rasul Goni ....Petitioner Mr. Shashanka Shekhar Saha ...for the petitioner Mr. Arindam Sen Mr. Sujan Chatterjee ....for the State Heard learned counsels for the petitioner and the State and perused the case diary.

The petitioner was the husband of the de facto complainant. He was in habit of taking money from others and could not repay the same.

It appears that one of the co-accused in this case has been granted anticipatory bail by the learned Sessions Court. Considering the materials available in the case diary and the role ascribed to the petitioner, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like

amount, one of whom must be local to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail four weeks from this date. The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
