Case No.42 of 2024 dated 22.05.2024 under Sections 447/325/326/307/354/34 of the IPC, 1860. And In the matter of:

Perused the case diary.

Considering the materials available in the case diary including the statements of the victim's wife recorded before the learned Magistrate, the other statements of witnesses and the injury report showing serious injury on the head, the alleged roles ascribed to the present petitioners, the fact that charge-sheet has been submitted, the petitioner Nos.1, 2 and 4 are female members of the family and the claim that the petitioner No.1 is in the advance stage of pregnancy, while I am inclined to grant anticipatory bail to the petitioner Nos.1, 2 and 4, the application for anticipatory bail of the petitioner Nos.3 and 5 (Sk. Nur Salam and Sekh Nakul @ Sk. Nokul) is rejected.

In the event of arrest, the petitioner Nos.1, 2 and 4 (Salma Khatun @ Salam Khatun, Ajmira Khatun @ Ajmira Bibi and Arjina Bibi) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner Nos.1, 2 and 4 shall surrender before the jurisdictional court within four weeks from this date and pray for bail and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, disposed of. Personal appearance of the investigating officer is noted and is dispensed with.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
