...for the petitioner The petitioner has preferred this application under section 126 of the Code of Criminal Procedure in the year 2021. According to the petitioner, till date the same is pending and is yet to be considered by the learned Judicial Magistrate, 2nd Court at Barasat.

The learned Judicial Magistrate is directed that on the next date i.e. 22nd February, 2024 the learned Court shall take steps for consideration of the application under section 126 of the Cr.PC. along with connected application. If evidence is required to be adduced, the same may be continued by fixing at least one date in every 45 days so that the application may be disposed of within a reasonable period of time preferably within six months from the date of next date so fixed.

With the aforesaid observation, CRR 4276 of 2023 is disposed of. Urgent photosat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
