IN THE HIGH COURT AT CALCUTTA

Item No.79 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.

Rejected C.R.M. (M) 2351 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Moyna Police Station Case No. 23 of 2025 dated 19.01.2025 under Sections 103(1)/238 of the Bharatiya Nyaya Sanhita, 2023.

And In Re : Pabitra Barman ... Petitioner.

Mr. Navanil De, Mr. Subhrajit Dey ... For the Petitioner.

Mr. Rudradipta Nandy, APP, Ms. Sanjana Saha ... For the State.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for ten months; investigation has already been concluded, charges have been framed and till date only one witness has been examined out of 35 witnesses proposed to be examined. As such, there is no scope for the trial to be concluded in near future and on any stringent condition, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are overwhelming materials appearing against the present petitioner.

Be that as it may, there is a possibility of the trial being delayed. Having regard to the same, State is directed to examine ten witnesses whom they consider vulnerable for

the purposes of the prosecution of this case and examination of the said witnesses be completed by 15th May, 2026. No unnecessary adjournment be granted to any of the parties by the learned Trial Court and trial of the case would continue in spite of any resolution of the local Bar. At this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after 15th May, 2026.

Learned advocate for the State would be at liberty to communicate this order to the learned Trial Court. The application for bail, being CRM (M) 2351 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
