Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and after being arrested, the petitioner is in custody for about 61 days and charge-sheet has already been submitted. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 125 bottles of Phensedyl were recovered which is the subjectmatter of the case. According to the State, the rigors of Section 37 of the NDPS Act are attracted.

Be that as it may, having considered that the petitioner has been implicated in the instant case because of statement of the co-accused as is reflected from the case records, I am of the opinion that further detention of the

present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Lalan Sheikh @ Sk @ Lalan Sk. shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional District & Sessions Judge, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without the leave of the learned Special Court. The application for bail, being CRM (NDPS) 1439 of 2025, is, thus, disposed of.
