Learned advocate appearing for the petitioner submits that 125 bottles of phensedyl were recovered from the possession of the petitioner and the petitioner is in custody for about eight months. It has additionally been submitted that although charge-sheet has been submitted, but charge has not been framed by the learned Trial Court. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that as one of the accused persons is absconding, trial of the case could not proceed.

I have considered the materials appearing in the case records. Having regard to the period of detention of the petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Alauddin Sheikh @ Jahangir @ Alauddin Shaikh @ Jahangir Shaikh shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional District & Sessions Judge, 2nd Court, Berhampore, Murshidabad.

If on bail, the petitioner shall meet with the Inspectorin-Charge, Raninagar Police Station or any officer authorised by him once in a fortnight till such condition is modified by the learned Special Court.

The petitioner shall also be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without the leave of the learned Special Court. The application for bail, being CRM (NDPS) 1440 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
