Petitioner is aggrieved by the fact that in spite of 13.08.2025 Court No. 35 M/L. No.65 Rakib informing the police authorities, no steps were taken. However, the records reflect that FIR was registered being Kolaghat Police Station case no. 591 dated 18.07.2024. Formal FIR reflects that the accusations are against Prasanta Mondal, Swarasati Mondal, Chandibala Mondal and Arpan Mondal, three of whom are private respondents in the present case.

Having considered that at the relevant point of time police authorities have registered FIR and there was accusations of grievous injuries. Petitioner naturally was aggrieved regarding slow progress of the investigation. Having considered that the writ petition was preferred in the year 2024 and the police authorities subsequently added Section 109 of BNS, 2023, I am of the view that police authorities had kept a vigil at the relevant point of time relating to the progress of the investigation. Since, substantial time has passed which is more than a year subsequent to the FIR being registered, if the petitioner is aggrieved in respect of any steps taken in course of investigation, petitioner would apply before the

jurisdictional Court in seisin of the Kolaghat PS case no. 591/2024, learned Court who is in seisin of the case would pass necessary orders as he deems fit and proper. With the aforesaid observations WPA 26376 of 2024 is disposed of.
