Petitioner has approached the police authorities 08.07.2025 Court No. 35 Item No.265 Rakib and to that effect alleged that the respondent Agomoni Realtors Private Limited their men and agents took physical possession of the property and subsequently did not restore the petitioner to his own possession. State has submitted a report prepared by the Officer-in-Charge, Howrah Police Station. It reflects from the report that an enquiry was conducted wherefrom it reflected a small garage was situated which was in the occupation of the petitioner and the petitioner prayed for a flat in lieu of his place from the developer for which hot altercation took place.

Learned advocate appearing for the respondents submit that they have purchased the property and do not recognize the petitioner.

Be that as it may, if the petitioner has documents in his possession, petitioner would in the present set of circumstances approach the Jurisdictional Civil Court for appropriate remedies.

Having regard to the fact that the nature of dispute complained is a private dispute, I am not inclined to interfere. Petitioner would take steps in accordance with law before the Civil Court.

With the aforesaid observations WPA 25988 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
