For the State It is contended on behalf of the petitioners that the first petitioner obtained permanent stage carriage permit in respect of the vehicle in question on Route No. DN8/1 from Barasat University to Tikiapara Bus Stand which is valid till 20th January, 2024. Since the first petitioner entered into an agreement for sale of the vehicle with the second petitioner in favour of whom offer letter has been issued for issuance of permit by the State Transport Authority, West Bengal, the first petitioner intends to surrender his permit before the concerned authority.
The first petitioner submitted an application in this regard before the Secretary, Regional Transport Authority, North 24 Parganas, being the 4th respondent herein on 25th July, 2022 in this regard which is yet to be considered.
The first petitioner prays for a direction upon the concerned authority to accept surrender of the permit by the first petitioner.
It is submitted on behalf of the respondents that the 4th respondent be directed to consider the application, in accordance with law.
In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the application submitted by the first petitioner dated 25th July, 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons, including the petitioners, if necessary, in accordance with law.
The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
