This is an application wherein petitioner has prayed for expeditious disposal of Title Suit No. 1158 of 2009 presently pending before learned XIth Bench, City Civil Court, Calcutta.

Petitioner contended that suit is pending for more than fifteen years and presently it has been deferred for peremptory hearing on 21st April, 2025 accordingly petitioner has prayed for a direction upon the Court below for expeditious disposal of the aforesaid Title Suit.

Since the prayer made by the petitioner is innocuous and if it is allowed in terms of prayer made in the application, neither party will have a cause to prejudice, the service of application and the notice upon the opposite parties are dispensed with.

Since the suit is pending exceptionally for a long period of time, I find that the prayer made on

behalf of the petitioner is justified and it is required to be allowed.

In such view of the matter, C.O. 3762 of 2024 is hereby disposed of with a direction upon the Court below, to make every endeavour for expeditious disposal of Title Suit No. 1158 of 2009 and to make its best effort to conclude the entire proceedings preferably within a period of six months from the next date of hearing.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
