The petitioner had originally sought to ascertain the medical condition of an accused in a case under Section 304 of the IPC. The accused admitted himself in Belle Vue Clinic and has evaded due process of law. It is submitted that since after filing of the writ petition the accused has been released by the Belle Vue Clinic and has been arrested.

Counsel for the State has provided all medical documents relating to the treatment of the accused. The Belle Vue Clinic shall continue to cooperate with the investigation as and when required by the investigating officer.

Considering the gravity of the offence, it is directed that the investigation into the matter shall be completed

as expeditiously as possible preferably within a period of three months from date.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

Since the respondents have not used any affidavits, the allegations made in the writ petition shall not be deemed to have been admitted by them.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
