It is submitted by the counsel for the petitioner that the order in question has been complied with.

The only question that remains is the punishment of the contemnor for the contempt committed.

Counsel for the petitioner and the counsel for the contemnor once again tender unconditional apology and seek mercy for the contemnor.

In view of findings of this Court recorded on April 28, 2023, the contemnor does not deserve mercy.

5.

However, in the facts and circumstances of this case, this Court imposes a penalty of "stern caution and admonition" on the contemnor. This penalty shall be entered into the service records of the contemnor

Mr. Alok Sarkar, Managing Director, West Bengal State Minor Irrigation Corporation Limited.

The contemnor is warned against any such conduct in future.

7.

The contempt application shall stand disposed of. Rule, if any, shall stand discharged.

8.

The personal presence of the alleged contemnor is dispensed with.

9.

There shall be no order as to costs.

10.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
