The petitioner prays for expeditious disposal of Misc. Appeal No. 87 of 2025, which is pending before the learned Additional District Judge, 1st Court at Barasat. The Misc. Appeal No. 87 of 2025 arises out of Title Suit No. 480 of 2024 which is pending before the learned Civil Jude (Senior Division), 1st Court at Barasat. 2.

It is submitted that the appeal was heard and thereafter the Court fell vacant as the regular court was transferred.

The prayer of the petitioners is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite parties.

As this is an appeal from an order of injunction there appears to be some urgency. The petitioner is at liberty to pray before the Judge-in-Charge to take up the

matter and dispose of the appeal expeditiously preferably, within two months from the next date fixed.

This Court has not expressed any opinion on the merits of the appeal. The learned Court shall proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite parties and/or the learned advocate contesting the matter on behalf of the opposite parties in the learned court below, within a week.

Accordingly, this revisional application is disposed of. There shall be no order as to costs.
