Sarkar ... for the petitioner Mr. Koushik Kundu Ms. Pallavi Priyadarshee ... for the State Learned senior counsel representing the petitioner submits that two other co-accused were discharged on the basis of their call tower location data. Moreover, although the victim was admitted in a hospital for 17 days, no dying declaration was recorded.
Learned counsel for the State opposes the prayer for anticipatory bail, relies on the statements of an independent eyewitness recorded before learned Magistrate and submits that according to the independent eyewitness, the petitioner was waiting on a motorcycle when the principal accused was inflicting the fatal blows on the victim and after the job was done, the two fled away on the motorcycle.
Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
