Mr. Subhankar Das ... For the petitioner. Mr. Shamim- Ul-Bari ... For the State. The petitioner on earlier occasion moved a writ petition being W.P.A. 15949 of 2019 on the self-same cause of action. A co-ordinate Bench of this Court by order dated July 19, 2022 dismissed the said writ petition on merit. The petitioner in the present writ petition has suppressed the aforesaid fact instead at paragraph. 15 stated that the petitioner has made no other application on the self-same cause of action in the Hon'ble Court. It is a clear case of suppression of fact.

W.P.A. 25964 of 2022 is therefore dismissed being barred by the principle of res judicata with costs of Rs. 10,000/- to be paid by the petitioner in favour of the High Court Legal Services Committee, Calcutta within a week from date.

The copy of the order dated July 19, 2022 passed in W.P.A. 15949 of 2019 supplied by Mr. Bari, learned advocate for the State be kept with the record. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
