1. This writ petition has been filed alleging inaction on the part of the respondent no. 4 i.e. Sub-Divisional Officer, Contai, Purba Medinipur in taking steps on the petitioners' representation dated September 15, whereby the petitioners have complained against unauthorized occupation of the Government land by the respondent no.12.

It is submitted by the learned Advocate appearing for the petitioners that despite several representations having been made before the respondent State authorities, last of which was made on September 15, 2025 (at pages 36 and 37 of the writ petition), no step has been taken by the respondent no. 4 against the respondent

no.12 to remove encroachment and unauthorized occupation on Government land.

3. Learned Advocate appearing for the respondent no.12 submits that the respondent no.12 is not in unauthorized occupation of any Government land as alleged at all. It is submitted that the dispute is private in nature and no Government land is involved.

4. Heard Learned Advocates appearing for the respective parties and considered the material-on-record.

5. Since a representation has been made to the Sub-Divisional Officer, Contai, Purba Medinipur i.e.

respondent no.4 on September 15, 2025 (at pages 36 and 37 of the writ petition), the said respondent shall consider the petitioners' representation and dispose of the same in accordance with law upon giving an opportunity of hearing to all concerned including the petitioners as well as the respondent no.12. Needless to mention that all parties shall be at liberty to produce all documents in support of their respective cases and the said SubDivisional Officer shall take an informed decision in the matter after considering the respective cases of all the parties, in accordance with law.

6. The said Sub-Divisional Officer shall conclude hearing as expeditiously as possible and pass a reasoned order, in accordance with law, which shall then be communicated to the parties within a week from passing thereof.

7. WPA 26078 of 2025 stands disposed of with the above observations.

8. There shall be no order as to costs.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
