Heard the learned counsels for the parties.

The grievance of the petitioner is that after acquisition of his land he applied before the Rehabilitation Advisory Committee for allotment of a plot in his favour for his rehabilitation. Such application was filed on 28th August, 2017, but has not been considered till date.

The State submits that an identical application was filed by the petitioner before the authority which was considered and rejected on 12th of November, 1997.

Having heard the learned counsels on behalf of the parties and considering the material on record, I am inclined to hold as the application filed by the petitioner on 28th August, 2017 is still pending,

necessary directions should be given to the relevant authority for disposal of the same.

Accordingly, I dispose of the writ petition with a direction upon the respondent no.3 for taking appropriate steps for disposal of the application dated 28th August, 2017 after affording an opportunity of hearing to all the affected parties including the petitioner, within a period of three months from the date of communication of this order, in accordance with law.

Accordingly, WPA 27038 of 2017 is disposed of. However, there shall be no order as to costs. Since no affidavit has been invited, the allegations made in the writ petition are deemed to be not admitted.

Urgent certified website copy of this order, if applied for, be given to the parties upon compliance of all formalities.
