Nilu Chowdhury v. State Of West Bengal & ANR
C.R.R. No.3447 of 2012 (Via Video Conference) D/L45.
September 23, 2021 Bpg.
In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.
Sri Nilu Chowdhury
Versus
The State of West Bengal & Anr.
Mr. Arijit Ganguly, Mr. Sandip Chakraborty.
...for the State.
As none appears for the petitioner or for the State, Mr. Sandip Chakraborty, learned advocate, who ordinarily appears on behalf of the State, is directed to appear and represent on behalf of the State. His appointment may be regularised by the concerned authorities.
The revisional application was preferred challenging Chitpur Police Station Case No.49 of 2012 dated 12.03.2012 under Sections 420/406/506(II)/504 of the Indian Penal Code. The revisional application was preferred at a stage when the investigation of the case was under progress. The order dated 13.02.2015 passed by a co-ordinate Bench of this Court reflects that the interim order was for a limited period for six weeks and the same was never extended. The documents, which have been relied upon by the petitioner, are private and personal documents, which cannot be assessed by a court in an application under Section 482 of the Code of Criminal Procedure.
Having regard to the stage at which the petitioner approached this Court, I am of the view that no interference is called for at this belated stage.
Accordingly, CRR 3447 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
