In the matter of : An application under Article 227 of the Constitution of India.
The present revisional application has been preferred against the order dated 2nd February, 2012 passed by the learned Judicial Magistrate, 3rd Court, Durgagpur in Misc. Case No. 13 of 2012(T. R. No. 05 of 2012) under section 125 of the Code of Criminal Procedure.
The order dated 2nd February, 2012 reflects that the learned Magistrate was pleased to award a sum of Rs.3,000/- as maintenance to the wife in a proceeding under Section 125 of the Code of Criminal Procedure.
Having regard to the meagre sum of money which has been awarded as maintenance, I am of the view that the quantum of maintenance do not call for any interference by this court.
Accordingly, the present revisional application being CRR 3451 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
The opposite party/wife will be at liberty to recover the arrears by taking out an appropriate application before the learned Magistrate.
