This revisional application has been filed challenging an order dated July 28, 2022 passed by the learned Judge, 10th Bench, City Civil Court at Calcutta, in Title Suit No.673 of 2019.

By the order impugned, the learned court accepted the written statement which was filed beyond the statutory period upon imposition of cost of Rs.5,000/-. This Court is of the view that the learned trial court had taken into consideration the principles of natural justice. If the defendant is not allowed to contest the suit is an adversarial form of litigation it will cause irreparable loss an injury. The defendant was rightly given an opportunity to contest the proceedings.

This Court does not find any reason to interfere with the order impugned.

Needless to mention, that the learned court shall dispose of the suit within eight months from date.

Accordingly, the revisional application is dismissed. There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
