Smt. Souma Ghosh Mr. Sounak Bhattacharya, Mr. Sounak Mondal, Mr. Anirban Saha Roy, Ms. Bipasha Bhattacharyya, .....for the petitioners This is an application for expeditious disposal of Mat Suit No. 01 of 2013, which is pending before the learned Additional District Judge 3rd Court at Alipore, South 24 Paraganas along with the pending application. The petitioner is aggrieved because the suit is pending for a long time.

No other interlocutory applications are pending.

It is submitted that the evidence was closed sometime in 2024 and the suit was fixed for arguments. It is also submitted that the unnecessary adjournment are being granted. The husband has specifically averred that regular maintenance as directed by the learned Court is being paid. The wife's application for enhancement of the maintenance was rejected.

The prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no

requirement for service of prior notice upon the opposite party.

The revisional application is disposed of with a request upon the learned court to dispose of the to make a sincere endeavour to dispose of the suit expeditiously, preferably within four months from the next date fixed. This court has not expressed any opinion on the merits of the suit. The learned court shall proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite party and/or the learned advocate contesting the matter on behalf of the opposite party in the learned trial court, within a week.

The revisional application is accordingly disposed of. There shall be no order as to costs.
