As none appears for the petitioner or for the State, Mr. Sanjib Kumar Dan, learned advocate, who ordinarily appears on behalf of the State, is directed to appear and represent on behalf of the State. His appointment may be regularised by the concerned authorities.

The present revisional application was preferred in respect of the order dated 13.09.2012 passed by the learned Additional Chief Judicial Magistrate, Arambagh in connection with Goghat Police Station Case No.115 of 2006.

The order dated 13.09.2012 reflects that the learned Magistrate was pleased to direct further investigation to be conducted by any other competent officer except the police officer who investigated the case.

Records of the revisional application reflects that the same has not been admitted till date, neither there was any interim order restraining the proceedings before the learned court below. Having regard to the fact that there was a direction for

further investigation at the instance of the order passed by the learned Magistrate, I am of the view that at this belated stage no interference can be made regarding the order which is under challenge.

Accordingly, CRR 3459 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
