The petitioners are the retired contractual employees of Burdwan Municipality. They seek for a direction upon the respondent authority for payment of one time cessation benefit.

It appears from the documents annexed to the writ petition that representations were forwarded to the municipality but there is no representation before the State Urban Development Agency. The Agency is responsible for providing funds for payment to the contractual employees.

Learned advocate appearing for the respondents submits that the Agency is the competent authority to take a decision as to whether

the one time cessation benefit will be paid to the petitioners or not.

As it appears that there is no representation before the Agency, accordingly, leave is granted to the petitioners to file a comprehensive representation with relevant documents in support of their prayer. In the event such a representation is made, the Director, State Urban Development Agency is directed to consider the said representation in the light of the various memoranda of the Finance Department, Government of West Bengal.

If the aforesaid respondent is of the opinion that the petitioners would be entitled to the relief as prayed for, then the same shall be disbursed in their favour at the earliest.

A decision shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order. The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, shall be furnished to the applicant at an early date.
