Kausik (Rejected) CRM (M) 2503 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Halisahar Police Station Case No. 129 of 2022 dated 22.06.2022 under Sections 302/201/34 of the Indian Penal Code, 1860.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years and 7 months and out of 35 witnesses cited by the prosecution only 11 witnesses have been examined till date.

Learned advocate further submits that the incident took place in the house of Surajit Adhikary, father-in-law of the present petitioner. Petitioner has been falsely implicated in connection with the instant case without any factual foundation and is unnecessarily languishing in jail. Learned advocate for the State, on the other hand, submits that blood stained wearing apparels were recovered at

the instance of the present petitioner and his foot prints have also tallied. It has also been submitted on behalf of the State that the motive in this case is established for financial gain. I have taken into account the broad outline of the case as well as the fact that more than 11 witnesses have been examined in this case. Having considered the post-mortem report and the injuries which are reflected therein, I am of the view that it would not be fit and proper to release the petitioner on bail at this stage. Steps be taken by the prosecution to expedite the trial.

Accordingly, CRM (M) 2503 of 2025 is dismissed at this stage.
