Mr. Himadri Kumar Mahata ..for the State Mr. Ashok Kumar Jena ..for the respondent nos.2 and 3 The petitioners claim to be the joint owners of R.S. Dag No. 239 corresponding to L.R. Dag No. 43, L.R. Khatian No. 159, J.L. No. 193 measuring about 25 decimals under Haldia Police Station in the District of Purba Medinipur. The petitioners alleged that the Port Trust authorities are trying to construct a boundary wall by encroaching upon the property of the petitioners. This Court by an order dated 6th February, 2026 directed the Block Land and Land Reforms Officer to make a spot enquiry and demarcation for the purpose of ascertaining whether any construction of the boundary wall has been made surrounding R.S. Dag No. 239 corresponding to L.R. Dag No. 43.

The Block Land and Land Reforms Officer, Brojolalchak being the 7th respondent was directed to file a report stating whether any boundary wall has been constructed surrounding the aforesaid plot.

Mr. Mahata, learned Additional Government Pleader files a report of the concerned Block Land and Land Reforms Officer dated 5th March, 2026 which is taken on record. A copy of such report has been supplied to the learned advocate for the petitioners and Mr. Jana, learned advocate representing the Port authorities.

From the said report it appears that the demarcation was carried out upon prior notice to the respective parties. The sketch map has been appended to the said report. The report further states that the suit plot i.e. L.R. Plot No. 43 is surrounded by L.R. Plot No. 108 of Haldia Dock Complex in West, South and North and at the East there is the land of Khasmahal department being plot no. 46(L.R.) which is lying as unused area. The report further states that the Haldia Dock Complex authority was constructing a boundary wall which is about 500 metres away from the plot in question. The report further states that the suit plot is in possession of the petitioners namely Bhaskar Parui and others.

The learned advocate appearing for the petitioners does not dispute the factual position as reflected in the report of the Block Land and Land Reforms Officer. Thus it appears that the grievance of the petitioners stands redressed with the carrying out of their demarcation by the concerned Block Land and Land Reforms Officer.

With the above observations, WPA 26081 of 2025 stands disposed of.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
