Mr. Abhra Mukherjee Mr. Souradeep Dutta Mr. Arpayan Mukherjee Mr. Swakshar Kumar Mondal Mr. Himadree Ghosh ...For the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the Title Suit No. 17437 of 2014 along with connected application, which are pending before the learned Civil Judge (Senior Division), 4th Court, Alipore, South 24-Parganas.

The grievance ventilated herein is that the said suit pending for more than 11 years before the Trial Court and though issues were framed in the year, 2018, trial has not yet been started in a suit for eviction of premises tenant. Since the prayer made on behalf of the petitioner is innocuous and if any order is passed in terms of the said prayer, neither party will have any cause to prejudice, service of notice and copy of the application upon the opposite parties are dispensed with.

Considering the age of the suit and that the issues of the suit has been framed on 10th May, 2018 and in spite of that the trial has not yet been commenced, I find that the prayer made by the petitioner is justified.

Accordingly C.O. 3764 of 2024 is hereby disposed

of with a direction upon the Court below to make every endeavour for expeditious disposal of the above mentioned Title Suit No. 17437 of 2014 pending before the Civil Judge (Senior Division), 4th Court, Alipore, South 24-Parganas and to make his best effort to conclude the entire proceeding of the suit preferably within a period of six months from the date of communication of this order.
