Mr. Kaushik Choudhury ....for the petitioner Mr. Bibaswan Bhattacharya Mr. Karan Bapuli ....for the State Learned counsel appearing on behalf of the petitioner submits that other than the statements of a co-accused there is no other incriminating material available against the present petitioner. The similarly circumstanced co-accused were granted anticipatory bail by this Court on 01.12.2025 in CRM(A) 3555 of 2025. Learned counsel appearing on behalf of the State files a report, which is taken on record. He relies on the case diary, the report and opposes the prayer for anticipatory bail. He submits that an ingenuine method was employed by the accused in this case. The accused used to obtain phone numbers/SIM cards in the names of others and used those said numbers to communicate among themselves. The statements of those persons implicate the petitioner. In view of the above and the other materials available in the case diary, the fact that the petitioner does not stand on the same footing who were granted anticipatory bail and the restriction contained in

Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
