The Superintendent of Police, Diamond Harbour Police District has filed a report dated 23rd February, 2023, which is taken on record.

The Superintendent of Police, Diamond Harbour Police District has sealed the entire premises. The SP has indicated that a sum of Rs.15,921/- as costs towards expenses for sealing the premise shall be deposited by the petitioner and the private respondents/alleged contemnors in equal shares by Monday.

The Superintendent of Police, Diamond Harbour Police District has also indicated that the cost of deployment of police to man the premises for a single day comprising of four constables is Rs.40,732/-. The petitioner and the private respondents/alleged contemnors shall deposit the above costs in advance for seven days on the beginning of each week.

The accessible portion on the backside of the premises may be sealed jointly by the petitioner and the

private respondents/alleged contemnors upon joint payment in the presence of the police personnel. The police shall be entitled to recover any unpaid costs by applying before the Civil Judge in TS No.85 of 2014. In the event of non-payment in advance as directed hereinabove or costs already incurred the Civil Judge shall be entitled to dispose of a portion of the said land to recover and pay any unpaid costs to the Police, together with 9% interest from both the parties.

In the event costs are not paid, the S.P. shall not be required to deploy any police at the property. The police shall ensure that neither the petitioner nor the private respondents/alleged contemnors in anyway enter into the said premises.

Accordingly, the contempt application shall stand disposed of.

Rule, if any, shall stand discharged.

There will be no order as to costs.

Interim orders, if any, shall stand vacated.
