The petitioner complains that though the petitioner company is not an accused in any cyber fraud, its bank account bearing no. 42705569760 with the Standard Chartered Bank has been marked as 'lien' in connection with a complaint lodged before the Cyber Crime Police Station, Malda. The said case pertains to a complaint lodged by the 4th respondent against the 5th respondent alleging that he supplied goods to the 5th respondent and was not paid for the same. The petitioner has no nexus whatsoever with the said transaction.

It appears from the report submitted by the State that no communication was made by the Cyber Crime Police Station, Malda to the bank for marking the bank

account of the petitioner as 'lien' or 'freezing' the said account.

Upon consideration of the material on record this Court is of the view that since there was no direction upon the bank to freeze the bank account of the petitioner or hold the said account as 'lien' in connection with the Cyber Crime Police Station, Malda, the 'lien' be lifted at once. Accordingly, the 3rd respondent is directed to lift the 'lien' in respect of the bank account of the petitioner with the Standard Chartered Bank bearing no. 42705569760 at once.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
