Petitioner renews the prayer for bail.

Learned Advocate appearing for the petitioner submits that some of the co-accused are on bail. He submits that, there is no eye-witness attributing any active role so far as the petitioner is concerned, in the incident of the death of the victim. He points out that, there was no progress at the trial till the intervention of this Court. In any event, he submits that possibility of the trial concluding in the near future is bleak.

State and de-facto complainant are represented.

Report submitted on behalf of the State filed in court today be taken on record.

Learned Public Prosecutor submits that, out of 22 prosecution witnesses, one was examined in part. The next date fixed in on March 29, 2025. He draws the attention of the Court to the materials on record. He submits that, the motor cycle belonging to the petitioner and the weapons used in the crime were recovered on the leading statement made by the petitioner.

Petitioner is in custody for a period slightly in excess of two years. Trial commenced.

All vulnerable witnesses are yet to depose.

Petitioner stands implicated in a crime of murder. One of the co-accused who stands implicated in murder, is yet to be arrested.

Considering the gravity of the offence and the fact that the trial is in progress with all vulnerable witnesses yet to be examined, we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected. 11.

C.R.M.(DB) No. 3670 of 2024 is dismissed.
